These Terms of Service govern your use of the BlueBotts website at bluebotts.com and any services provided by BlueBotts, including WordPress maintenance plans, security services, backup management, performance optimisation, uptime monitoring, emergency support, plugin development, site audits, and related website care services.
By visiting our website, submitting an enquiry, signing up for a plan, or engaging us for any service, you agree to these terms.
Where a separate signed agreement, proposal, statement of work, or invoice contains additional or different terms for a specific engagement, those terms apply alongside or in place of these where there is a conflict. Please also read our Privacy Policy, Cookie Policy, and Work Policy.
Our Services
BlueBotts provides ongoing WordPress website care to businesses and agencies.
Our services include WordPress core, theme, and plugin updates; malware scanning, removal, and hardening; website backup setup, monitoring, and restoration; uptime monitoring and alerting; website performance optimisation; content and design edit support; emergency recovery for hacked, broken, or inaccessible websites; white-label maintenance for agencies; site health audits; custom plugin development; and consultancy relating to WordPress infrastructure, security, and hosting.
The exact services included in your engagement depend on the plan you selected, a written proposal, or a confirmed invoice.
BlueBotts reserves the right to update, discontinue, or modify services with reasonable notice, and will not remove features essential to your plan during an active billing period without offering a suitable alternative or pro-rata refund.
Plan Scope and Included Work
Maintenance plans are ongoing care services for an existing, functional WordPress website. They are not unlimited development retainers and do not include building new websites, redesigning existing sites, developing custom features beyond minor edits, migrating to new platforms, or producing large volumes of new content.
The scope of included edits, task types, and turnaround commitments is described on the Work Policy page and any plan documentation you received at sign-up. Tasks that fall within scope will be carried out within the applicable turnaround time.
Tasks that fall outside scope will be quoted separately before any work begins. BlueBotts will not carry out chargeable work, make structural changes, or install major plugins or themes without your explicit written approval, even if we believe those changes would benefit your site.
Client Responsibilities
To allow us to deliver your service effectively, you are responsible for providing accurate information about your website, hosting, and business requirements at onboarding and whenever material changes occur.
You must provide timely access to your WordPress admin panel, hosting control panel, FTP or SSH credentials, DNS settings, and any third-party accounts required to perform the agreed work. Where access is required for emergency work or security incidents, delays caused by unavailable credentials or approvals may affect resolution time.
You are responsible for maintaining valid, paid licences for premium plugins, themes, and third-party tools used on your site. You must ensure that your website content, imagery, data, and integrations comply with applicable laws and do not infringe on the rights of others.
You are responsible for backing up content, databases, and files prior to any major changes unless backup services are explicitly included in your plan. Where you request edits, approvals, or feedback, timely responses help us meet the turnaround commitments in our plan documentation.
Access and Credentials
We treat all access credentials – including WordPress admin logins, hosting credentials, FTP details, API keys, and third-party account access – as confidential and use them only to perform the services included in your plan. We store credentials securely with restricted access.
We recommend using dedicated WordPress admin accounts for BlueBotts access rather than sharing your primary admin credentials, and we recommend changing access credentials promptly if your engagement with us ends or if a security incident occurs.
We will never use access provided for maintenance purposes to make changes outside the agreed scope, to access data unrelated to service delivery, or to share your credentials with any party not directly involved in performing your service.
Onboarding and Site Readiness
After subscribing to a plan, you will receive onboarding instructions explaining the access and information we need to get started. Work on your plan begins once we have confirmed access to all required systems. If access is delayed or incomplete, the start of your service period may be adjusted accordingly.
We carry out a baseline assessment of your site during onboarding to identify pre-existing issues such as outdated software, active malware, broken plugins, hosting misconfigurations, or unstable third-party integrations.
Where pre-existing issues are found that fall outside the scope of ongoing maintenance, we will flag them separately and quote for remediation if required. Ongoing maintenance obligations do not include remediating pre-existing conditions unless specifically agreed.
Payments and Billing
Fees, billing cycles, and payment methods are shown on the relevant plan page, proposal, or invoice at the time of purchase. Monthly plans are billed in advance at the start of each billing cycle. Annual plans are billed in full at the start of the subscription year.
Prices may be subject to applicable taxes depending on your billing address and local regulations. Payment must be made in full and cleared before work begins on a new engagement or before a renewal period commences.
If a payment fails, we will notify you and attempt reprocessing according to our payment provider’s retry schedule. If a balance remains unpaid after reasonable notice, we may pause or suspend services until the account is settled.
We reserve the right to adjust pricing for renewals with at least 30 days’ written notice before the next billing date. For quoted or fixed-fee projects, payment terms are stated in the proposal or invoice and govern that engagement.
Renewals and Cancellations
Monthly maintenance plans renew automatically at the end of each billing cycle unless cancelled. To cancel, notify us in writing at hello@bluebotts.com before the renewal date. Cancellation takes effect at the end of the current billing period; you retain access to services until that date.
We do not carry forward unused edit requests or task credits to a subsequent period.
Annual plans may have a minimum commitment period stated at sign-up; early cancellation of an annual plan may not be eligible for a pro-rata refund unless the cancellation is due to a material failure on our part.
On cancellation, we will provide a handover summary of any relevant site access changes, monitoring configurations, or ongoing tasks, and we will revoke our own access to your website within a reasonable period after the final billing date.
Refunds
Monthly plan fees paid in advance are generally non-refundable once the billing period has started, as we allocate capacity and begin ongoing monitoring immediately.
If you experience a material service failure on our part and we are unable to resolve it within a reasonable time, we will consider a pro-rata credit or refund on a case-by-case basis.
For quoted or fixed-fee projects, refund eligibility depends on the stage of work completed and is set out in the applicable proposal or invoice. Emergency support, one-time audits, and other ad hoc services are non-refundable once delivery has begun.
If you believe you are entitled to a refund, contact us at hello@bluebotts.com and we will review your request fairly and promptly.
Emergency Support and SLA Commitments
Emergency support response times, monitoring check intervals, recovery time objectives, malware handling procedures, and Enterprise-tier SLA commitments are described on the relevant plan documentation and the FAQ and SLA page. These commitments represent our targets and are based on normal operating conditions.
Actual resolution times can vary depending on factors outside our control, including hosting provider responsiveness, DNS propagation delays, third-party plugin vendor support, malware complexity, the availability of clean backups, and the timeliness of your approvals or access.
We will communicate clearly about progress, blockers, and estimated timelines during any active incident. SLA credits or remedies, where applicable, are described in your plan documentation and require a valid claim submitted within the timeframe stated there.
Third-Party Services and Dependencies
WordPress websites depend on a range of third-party services including hosting providers, domain registrars, SSL certificate authorities, payment gateways, email platforms, plugin and theme vendors, CDN providers, analytics tools, CRM integrations, and API services.
BlueBotts is not responsible for outages, policy changes, price increases, account suspensions, licence failures, security vulnerabilities, or data loss caused by third-party providers operating outside our direct control.
Where a third-party issue affects your website, we will help diagnose the problem, communicate with the relevant provider on your behalf where we have that access, and implement any fix that falls within our service scope.
Issues caused entirely by a third-party provider are not grounds for refund or SLA credit unless our own monitoring or maintenance contributed to the problem.
Security and Backups
We apply security best practices to all maintenance work, including keeping WordPress core, themes, and plugins updated, scanning for malware, configuring security hardening where included in your plan, and monitoring for known vulnerabilities.
However, no website can be guaranteed immune from attack, data breach, zero-day exploits, hosting-level compromise, or supply chain vulnerabilities in third-party plugins or themes. Our security work substantially reduces risk but does not eliminate it entirely.
Backup services, where included in your plan, cover scheduled automated backups stored in a secure off-site location. Backup retention periods, frequency, and restoration scope are described in your plan documentation. We recommend that you also maintain your own independent backups through your hosting provider or a separate backup solution.
We are not liable for data loss arising from hosting failures, database corruption, accidental deletion by authorised users, or events outside the scope of the backup service included in your plan.
Intellectual Property
You retain full ownership of your website content, brand assets, images, copy, data, and any materials you provide to us. BlueBotts retains ownership of its proprietary tools, processes, templates, documentation, code libraries, and know-how developed independently of your engagement.
Where we create custom code, design assets, or written content specifically for you as part of a quoted deliverable, ownership of those deliverables transfers to you upon receipt of full payment unless the applicable agreement states otherwise.
Ongoing maintenance work – such as applying updates, configuring plugins, or adjusting settings – does not create new intellectual property owned by BlueBotts. Plugin development and custom theme work will include specific IP terms in the applicable proposal or statement of work.
Confidentiality
Both parties agree to treat confidential information shared in the course of the engagement with reasonable care. BlueBotts will not disclose your website credentials, business information, client data, or commercially sensitive information to any third party except as required to perform the services or as required by law.
We will not use your confidential information for any purpose other than delivering your service. You should treat any non-public information about our processes, pricing structures, internal tooling, or unreleased features as confidential. Confidentiality obligations survive termination of the engagement for as long as the information remains non-public.
Acceptable Use
You agree not to use our website or services in a way that violates applicable law, infringes the rights of any third party, or compromises the security or integrity of our systems or other clients’ websites.
Prohibited uses include attempting to gain unauthorised access to our systems or any other website; submitting malicious files, scripts, or code through our audit tool, support channels, or any other input; using our services to host, distribute, or facilitate illegal content, spam, phishing, or fraud; abusing support channels in a way that disrupts our ability to serve other clients; and engaging BlueBotts to carry out maintenance on websites used for unlawful, harmful, or deceptive purposes.
We reserve the right to suspend or terminate your service immediately if we reasonably believe your use of our services violates this acceptable use policy, without liability for refund of any fees paid.
Disclaimers
BlueBotts provides services with reasonable care, skill, and technical competence. We do not guarantee that your website will experience zero downtime, zero security incidents, or zero data loss.
We do not guarantee specific search engine rankings, traffic levels, conversion rates, or revenue outcomes as a result of maintenance, performance, or SEO-related work. We do not guarantee compatibility between every plugin, theme, hosting environment, and third-party integration, as these combinations can be unpredictable.
Where a specific outcome is important to you, discuss it with us before engaging so we can advise on feasibility and scope. Our services are provided on an “as available” basis and may be subject to scheduled or emergency maintenance windows that affect availability.
Limitation of Liability
To the fullest extent permitted by applicable law, BlueBotts will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, or the cost of procuring substitute services, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or related to these terms or our services – whether in contract, tort, strict liability, or any other legal theory – will not exceed the total fees paid by you to BlueBotts in the three months immediately preceding the event giving rise to the claim, or the fees paid for the specific service at issue if lower.
These limitations apply even if any limited remedy fails its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain types of damages; in those cases, our liability is limited to the fullest extent permitted by local law.
Indemnification
You agree to indemnify, defend, and hold harmless BlueBotts and its personnel from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your breach of these terms; your violation of any applicable law or third-party right; the content, data, or materials you provide to us or publish on your website; your misuse of any service; or any claim by a third party arising from your website or business operations.
We will notify you promptly of any claim for which we seek indemnification and will cooperate reasonably with your defence at your expense. We reserve the right to take control of our own defence where we believe our interests are at risk.
Governing Law and Disputes
These terms are governed by and construed in accordance with the laws of the jurisdiction in which BlueBotts is registered and operates.
If a dispute arises from or relates to these terms or any service provided by BlueBotts, we encourage you to contact us first at hello@bluebotts.com so we can attempt to resolve it informally. If informal resolution fails, disputes may be referred to mediation before any formal legal proceedings.
Nothing in these terms prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm. For EU consumers, the European Commission’s Online Dispute Resolution platform may be available as an alternative resolution mechanism.
Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices.
When we make material changes, we will update the “Last updated” date at the top of this page and, where the change significantly affects active clients, we will notify you by email at least 14 days before the new terms take effect.
Minor or clarifying changes may be posted without individual notification. Continued use of the website or services after updated terms are posted means you accept the revised terms.
If you do not agree with a material change, you may cancel your service before the effective date of the new terms in accordance with our cancellation process.
